UPDATE: JAN 14: Trader John’s has covered up their sign. Apparently the idea didn’t fly past the lawyers.
Jan. 9 (Bloomberg) — Trader Joe’s Co., the operator of specialty grocery stores, sued Gristede’s Foods Inc., alleging the supermarket chain committed trademark infringement by opening a food market in New York called Trader John’s.
Gristede’s is opening the Trader John’s “knock-off food market” three blocks from a Trader Joe’s store in Manhattan, according to a complaint filed Jan. 8 in federal court in New York. The Trader John’s name misleads consumers and diminishes the Trader Joe’s brand, according to the complaint.
“We take seriously any attempt to infringe on our trademark and we are taking the necessary action to stop this particular attempt,” Trader Joe’s spokeswoman Alison Mochizuki said in an e-mailed message.
The lawsuit has no merit, said John Catsimatidis, Gristede’s chief executive officer.
“My name is John and I am a trader so I don’t know what their problem is,” he said in a telephone interview. Gristede’s lawyers haven’t seen the complaint yet, Catsimatidis said. “We’ll see what happens.”
The Trader John’s store at 5 West 14th St. in Manhattan will open Jan. 15, Catsimatidis said.
The Trader Joe’s store is three blocks away at 142 East 14th St. The company has 300 locations in 25 states and Washington. Gristede’s has about 35 shops in the New York area, Catsimatidis said.
Trader Joe’s sent a “cease and desist” letter Jan. 6 to Gristede’s, asking it to “immediately change the name and decor of the infringing store,” according to the company’s complaint.
Next week (July 15 to July 19), material and equipment deliveries and installation work will continue on all floors inside the building. We will be working on the new sidewalk around the building on 13th st. Additionally we will be working on the roofs of the building.
The following week (July 22 to July 26), material and equipment deliveries and installation work will continue on all floors as well as sidewalk work.
This weekend the site will be open on Saturday, July 13th for interior, roof, and sidewalk activities between the work hours of 7AM and 5PM as permitted by the City.

Beauty brand NYX Cosmetics signed a lease for a new store on Union Square West, a 2,800-square-foot space on the ground floor of Brause Realty’s 75,000-square-foot commercial building at 41 Union Square West, at the corner of East 17th Street. The lease was signed earlier this month. It’s where Starbucks was before it moved.
The youth-focused chain chose a location close to New York University and nestled among a concentration of cosmetics stores ringing Union Square, including Fresh, Bluemercury and Sephora, each within a block of the new location. On the south side of Union Square, Estee Lauder’s MAC inked a lease at the Feil Organization’s 853 Broadway two years ago.
Construction of the glassy turtle shell-shaped dome on top of Union Square’s landmarked Tammany Hall building is officially underway. The building at 44 Union Square, formerly home to NYC’s Democratic party machine, is being transformed into modern office and retail space. New construction photos provided to 6sqft show the start of the unconventional dome’s installation, with the diagonally intersecting glass and steel now visible from the street. The political organization of Tammany Hall formed in New York City in the late 18th century and helped Democrats control city and state politics for decades. After a few different headquarter locations, the society landed in a building on East 17th Street and Union Square. The International Ladies Garment Workers Union bought the building in 1943. Other tenants have included the New York Film Academy and the Union Square Theatre. Designed by BKSK Architects, the redevelopment project consists of a gut renovation and the addition of four stories of retail space in the building’s base, with three levels of office space on the upper levels, including inside the dome. The architects designed the glass dome as an ode to the turtle which Lenape Chief Tamanend stands upon on a Philadelphia statue. Tammany Hall was named after the leader. According to the firm, the dome is “meant to be both evocative and respectful of the building’s past while also bringing architectural spectacle to this rather staid corner of Union Square.” BKSK first submitted plans to revamp the historic building in 2014. After the project was approved a year later by the Landmarks Preservation Commission, developer Reading International secured $57.5 million in financing. Renovations began in 2016. The dome features a framework of intersecting glass and steel, manufactured by German-based firm Gartner. There’s no doubt the top floor will not only be drenched in natural light but also offer unique views of Union Square and beyond.
