UPDATE: JAN 14: Trader John’s has covered up their sign. Apparently the idea didn’t fly past the lawyers.

Jan. 9 (Bloomberg) — Trader Joe’s Co., the operator of specialty grocery stores, sued Gristede’s Foods Inc., alleging the supermarket chain committed trademark infringement by opening a food market in New York called Trader John’s.

Gristede’s is opening the Trader John’s “knock-off food market” three blocks from a Trader Joe’s store in Manhattan, according to a complaint filed Jan. 8 in federal court in New York. The Trader John’s name misleads consumers and diminishes the Trader Joe’s brand, according to the complaint.

“We take seriously any attempt to infringe on our trademark and we are taking the necessary action to stop this particular attempt,” Trader Joe’s spokeswoman Alison Mochizuki said in an e-mailed message.

The lawsuit has no merit, said John Catsimatidis, Gristede’s chief executive officer.

“My name is John and I am a trader so I don’t know what their problem is,” he said in a telephone interview. Gristede’s lawyers haven’t seen the complaint yet, Catsimatidis said. “We’ll see what happens.”

The Trader John’s store at 5 West 14th St. in Manhattan will open Jan. 15, Catsimatidis said.

The Trader Joe’s store is three blocks away at 142 East 14th St. The company has 300 locations in 25 states and Washington. Gristede’s has about 35 shops in the New York area, Catsimatidis said.

Trader Joe’s sent a “cease and desist” letter Jan. 6 to Gristede’s, asking it to “immediately change the name and decor of the infringing store,” according to the company’s complaint.

Next week (June 4 to June 5), Superstructure work will continue at the 18th floor level. The superstructure concrete work will be completed on the building buy the end of the month. Deliveries for the internal systems of the building have been ongoing and will continue, although they should not greatly affect the flow of pedestrian and road traffic.

The following week (June 11 to June 15), we will be working on the machine room levels on the 18th floor. The crane on site will be demobilized and removed from site at the end of June.

This weekend the site will be open on Saturday, June 2nd for superstructure related activities between the work hours of 7AM and 5PM as permitted by the City. To control noise levels within the site, work activities will be limited to the placement of formwork and concrete, plumbing and electrical work, rebar for concrete placement, using the crane and equipment to support all activities. Safety horns are used, and required by law, to coordinate lifting with the crane and to alert the workers of the danger overhead. We have directed the operators to limit the use of horns to one short sounding and to use the crane later in the day so as to avoid any excess noise.

Down the block on 13th St. you can see the tallish building that is now apartments. Ah, the good old days. Note that even in 1911, those elegant brownstones had seen better days. Since then, three large buildings have stood on this block, so that’s one reinvention about every 35 years.

Chick-fil-A is negotiating a lease for a Union Square location formerly occupied by popular restaurant Bluewater Grill. The fast-food chain, known for its chicken sandwiches and controversial support of antigay groups and issues, is likely to open an outpost at 31 Union Square West. Tthe landlord had been asking for nearly $2 million in annual rent, which is what drove Bluewater Grill to close. It isn’t clear whether Chick-fil-A will take the entirety of the roughly 11,000-square-foot vacancy and what the Atlanta-based chain is agreeing to pay in rent.

Next week (April 11 to April 15), Contractors will continue to excavate earth and rock, and load out material. We will continue to underpin both adjacent buildings with DOB approval of our means and methods. Drilling of tie-backs, lagging and sheeting around the perimeter will progress as well.
